Form Requirement by 11/15/07
Massachusetts
employers with 11 or more fulltime equivalent employees are required to file
a Fair Share Contribution and Health Insurance Responsibility Disclosure (HIRD)
form by November 15, 2007 regardless of whether the
employees reside in Massachusetts.

What
Other Reporting Responsibilities Will Be Satisfied by the Employer Filing
the Fair Share Contribution Report with DUA?
In order to ease an additional
reporting requirement placed on employers by Chapter 58 of the Acts of
2006, DUA has incorporated into the FSC filing process the employer Health
Insurance Responsibility Disclosure (“HIRD”) information that
must be submitted to the Commonwealth’s Division of Health Care Finance
and Policy. This makes it possible for the employer to satisfy two
required reports in one on-line filing.
HIRD questions address
such items as whether employers with 11 full-time equivalent (FTE) employees
have set up a Section 125 Cafeteria Plan (IRS code), a qualified health
insurance plan where employees can pay group insurance premiums on a pre-tax
basis. HIRD related questions included in the DUA filing also facilitate
the reporting of additional information required by Division of Health
Care Finance & Policy (DHCFP) regulation. DUA will share the
employers’ responses with DHCFP, thereby relieving the employer of
the requirement to submit a separate report to that division.
